Acceptable Use Policy

This Acceptable Use Policy ("AUP") is part of theFluxPT Service Termsand applies to all users of the FluxPT platform. By using FluxPT, you agree to comply with this policy.

1. Prohibited Activities

You may not use the FluxPT Service to:

1.1 Illegal Activities

  • Violate any applicable local, state, national, or international law or regulation
  • Process, store, or transmit PHI in violation of HIPAA or other healthcare regulations
  • Engage in fraudulent billing practices or submit false insurance claims
  • Facilitate money laundering, terrorism financing, or other financial crimes

1.2 Harmful Content

  • Transmit malware, viruses, worms, Trojan horses, or other malicious code
  • Upload or distribute content that is defamatory, harassing, or threatening
  • Share content that infringes intellectual property rights of others
  • Distribute spam, phishing content, or unsolicited communications

1.3 System Abuse

  • Attempt to gain unauthorized access to FluxPT systems or other users' accounts
  • Interfere with or disrupt the integrity or performance of the Service
  • Conduct vulnerability scans, penetration tests, or security assessments without authorization
  • Overload our infrastructure with excessive requests (denial of service)

2. Data Protection Requirements

2.1 Account Security

Important: Each user must have their own unique login credentials. Sharing accounts across multiple staff members is a violation of this policy and HIPAA.

  • Maintain the confidentiality of your login credentials
  • Use strong, unique passwords for your FluxPT account
  • Enable multi-factor authentication (MFA) when available
  • Immediately notify us of any suspected unauthorized access
  • Log out of shared workstations when not in use

2.2 PHI Handling

  • Only access PHI that is necessary for your job duties (minimum necessary standard)
  • Do not download PHI to personal devices unless authorized by your organization
  • Do not share PHI via unsecured channels (personal email, SMS, social media)
  • Report any suspected PHI breaches immediately to your privacy officer and to FluxPT

3. Intellectual Property Protection

3.1 No Reverse Engineering

  • Do not decompile, disassemble, or reverse engineer any part of the FluxPT software
  • Do not attempt to derive the source code, algorithms, or data structures
  • Do not create derivative works based on FluxPT without written permission

3.2 No Scraping or Automated Access

  • Do not use bots, spiders, crawlers, or automated scripts to access the Service
  • Do not scrape, extract, or harvest data from FluxPT for any purpose
  • Do not mirror, frame, or replicate any portion of the FluxPT interface
  • API access is governed by separate API terms and rate limits

3.3 Competitive Use

  • Do not use FluxPT to develop a competing product or service
  • Do not benchmark FluxPT performance for competitive analysis without consent
  • Do not share FluxPT features, pricing, or documentation with competitors

4. Resource Usage

4.1 Fair Use

FluxPT is designed for clinical documentation and practice management. Usage patterns that significantly deviate from normal clinical workflows may be subject to review.

  • Excessive API calls that impact service performance
  • Bulk operations that strain system resources
  • Storage of non-clinical data unrelated to patient care

4.2 Storage Limits

Each account is subject to reasonable storage limits as defined in your subscription plan. We reserve the right to require removal of excessive data or upgrade to a higher tier.

5. Enforcement

5.1 Monitoring

FluxPT reserves the right to monitor usage patterns to ensure compliance with this AUP. Monitoring is conducted in accordance with ourPrivacy Policyand HIPAA requirements.

5.2 Violations

If we determine that you have violated this AUP, we may take any of the following actions:

  • Issue a warning requiring immediate corrective action
  • Temporarily suspend your access to the Service
  • Permanently terminate your account
  • Report violations to appropriate authorities (e.g., HIPAA violations to HHS)
  • Pursue legal remedies for damages

5.3 Reporting Violations

If you become aware of any violation of this AUP, please report it immediately toabuse@fluxpt.com.

6. Updates to This Policy

We may update this AUP from time to time. Material changes will be communicated via email or through the FluxPT platform. Your continued use of the Service after changes take effect constitutes acceptance of the updated policy.
